This paper aims to trace the development of the Assize Courts in republican Italy through a historical-institutional investigation. The reform of the Assize legislation is part of a broader interpretative framework along the line between rupture and continuity of state institutions in the years of transition from the previous liberal and fascist system. Focusing mainly on parliamentary sources, the investigation aims to reconstruct the institutional profiles that, starting with the constitutional dictate of Article 102 of the Constitution, characterized the reintroduction of this body into the national judicial system, as well as the legislative process that followed.
